Mortgage lenders have no duty of care toward consumers since imposing a duty of care would cripple the lending industry. The court awarded attorney's fees ($5,000) to Chase Manhattan finding that bringing a lawsuit against a mortgage lender is frivolous. The punitive attorneys fees were awarded against Sheerin without a single hearing, and without any notice that filing a lawsuit would be considered frivolous: no statute, no case law, no regulatory law, nothing that would give Sheerin notice filing the lawsuit would bring a $5,000 fine... a blatant violation of Sheerin's constitutional due process rights. If you are considering filing suit against a large US corporation, you might want to think again. This case represents the true state of of our legal system.
